Consular Process

The Consular Process is a way for individuals to apply for a Green Card outside of the United States. After the approval of a petition (Form I-130 or I-140), the applicant must complete the DS-260, Immigrant Visa Electronic Application, and attend an interview at a U.S. embassy or consulate in their home country. Required documents include a valid passport, birth certificate, police clearance certificate, and a medical examination report. The applicant must also demonstrate that they will not become a public charge in the U.S.
For those who have entered the U.S. illegally and/or have been in the country without authorization, they may need to apply for a Form I-601A, Application for Provisional Unlawful Presence Waiver before consular processing. This waiver allows individuals to request forgiveness for their illegal entry and/or unauthorized stay, enabling them to leave the U.S. to attend their interview without fear of being denied re-entry due to accrued unlawful presence.
